The Golden Times Promotion (“Promo”) is being organized by PepsiCo India Holdings Private Limited (“Organizer”). It is valid only on 250 ml, 300 ml, 500 ml,600 ml, 750 ml, 1.2l, 2l, 2.25l PET bottles of brand “Pepsi, 7UP, Mirinda, Mountain Dew, Slice” plying this offer, hereinafter referred to as “Product/s”.

Promo is valid from December 1st, 2018 to January 31st, 2019, both dates inclusive (“Promotion Period”), in the states of Andhra Pradesh, Telangana, Tamil Nadu, Kerala, Karnataka, Gujarat and Maharashtra. For the purpose of determining the participating region, the circle/registration details of the mobile phone used for participating in the Promo would be the deciding factor and not the physical location of the Participant.

In case participation is received from any region or state other than the states or regions stated above, the Organizer would be at liberty to reject such entries.

Participation in the Promo is optional. Product without this Promo is also available.

Promo is open to all Indian citizens residing in India, above 18 years of age (“Participant”). The Promo is not open to the employees of Organizers, their family members, Organizers’ associate companies, its bottlers, its JV partners, its co-packers, its distributors, its agents, its advertising and promotional agencies and its auditors and their associate companies or any person who is not “competent to contract” within the meaning of the Indian Contract Act, 1872.

HOW TO PARTICIPATE:

The Participant must purchase any Product to participate in the Promo and must look under the cap of the purchased Product where he/she will find a 8 digit code (“Promo Code”), except for Slice. For Slice, the Participant has to look for the Promo Code, behind the label of the purchased Product.

The Participant can participate in the Promo only once through purchase of one Product. For instance, if a Participant avails the Prize once, he / she will not be entitled to win a Prize through the Promo Code of the same Product pack through which he/she previously participated. To avail the offer again, the Participant will have to purchase another pack of the Product. Any participation without the Promo Code or with fake code, will be considered invalid.

Participant shall, after obtaining the Promo 8 digits unique Code by purchasing the Product, SMS the Promo Code to 9223492234.

ASSURED PRIZE:

Upon sending the SMS in accordance with these terms and conditions, the Participant will receive an SMS from or on behalf of the Organizer, containing a seventeen (17) digit code (“17 Digit Code”) which shall be entered by the Participant (Rupees Twenty only) on https://amzn.to/2SjZBsA or on the Amazon shopping mobile application, to avail Assured Prize i.e. Rs. 20/-. By clicking on this link, Rs. 20/- will get added to their Amazon Pay account. Thereafter, the Participant can check his/ her Amazon Pay balance to confirm him/her having availed the Assured Prize and Rs. 20 only) has/- (Rupees Twenty been added to his Amazon Pay Wallet. (“Assured Prize”). Valid once per Amazon account. Assured Prize is the minimum gratification for participating in this Promo

One unique mobile number can avail the Assured Prize, only once during the Promotion Period.

The Assured 17 Digit Code must be claimed before January 31st, 2019.However, the Assured Prize can be redeemed on any product on Amazon.in within one year of adding the balance

All Amazon service related complaints/queries etc. shall be directly taken up by the participants with Amazon at their website, i.e https://www.amazon.in/gp/help/customer/display.html. The redemption of the Assured Prize shall be governed by the standard Amazon Pay Gift Card T&C’s as perhttps://www.amazon.in/gp/help/customer/display.html?nodeId=202112070.

Participant agrees that use of this Promo is at his/her sole risk. PepsiCo, Amazon and its affiliates, and their officers, directors, employees, and agents disclaim all warranties, express or implied, including without limitation any warranty of merchantability, availability, and fitness for a particular purpose or non-infringement.

MEGA PRIZE

From amongst all the Participants who participate in the Promo as mentioned above in Clause 6, Participants also stand a chance to win “Mega Prize, i.e one gold coin of 22 Karat, 10 g”, every hour of the day from 10 AM to 8 PM (“Mega Prize”). For Tamil Nadu, the Participants are mandatorily required to answer a question, i.e “PepsiCo I love Ponneram because_____________”, in not more than 140 words. For every valid code, the first response describing the Participant’s love for Ponneram will be considered for evaluation. Each first response will be evaluated on the creativity of the response received by an independent auditor appointed by the Organizers. Only those entries which are selected by the independent auditor shall stand a chance to win the Mega Prize-one gold coin of 22 Karat, 10 g.

The data maintained for the judging process by the Organizer would be considered final.

For Tamil Nadu, only the selected entries as detailed in Para 8a) above, and for rest of the states where this Promo is valid, all the SMS’s received by the Organizer with a valid Promo Code, pursuant to the Promo, as per these Terms and Conditions, will be put through a randomizer software , every hour of the day between 10 AM and 8 PM during the Promo Period.

A total of 10 (1 every hour of the day) Mega Prize Winners will be selected through the randomizing software, under this Promo. In case of rejections due to technical or other reasons alternates may need to be selected.

The Organizer will inform the Mega Prize Winners of their winner status post completion of the audit and other verification formalities.

One Participant, irrespective of the number of mobile number he/ she owns or possesses, can participate by entering a valid Promo Code, to get a chance to win the Mega Prize, to a maximum of 10 times

In an event, where Participant has participated in the Promo using two different mobile numbers, and in case both his/her mobile numbers are selected through the randomizer, then he/she will be entitled to claim two Mega Prizes, and will be eligible to a maximum number of 10 times for each mobile number.

Presentation of the original code bearing winning label /crown to the Organizer or its authorized representatives is mandatory to claim the Mega Prize. In case the code bearing winning label / crown is not presented, lost, misplaced or mutilated, the Organizer would be within his rights to pass the Prize to another Participant or to forfeit the Prize, without any further communication to the Participant.

It is clarified that in case the Participant wins a Mega Prize, the Organizer may at its sole discretion ask the claimant to mandatorily produce documentary evidence to prove that the Participant bought the Product. In case, the claimant is unable to provide any such document to the satisfaction of the Organizer, the Organizer will have the sole discretion to either forfeit the Mega Prize or pass it on to the next winner claimant.

The delivery of the Mega Prize shall be done directly by CaratLane and winner shall duly acknowledge the same, on receipt. In case of any issues regarding the Mega Prize, the winner shall intimate the Organizer within 3 days of receipt of the Mega Prize. No complaints shall be entertained by the Organizer, after the said period.

Any attempt to participate in the Promo without purchasing a Product plying this Promo or with a fake code, will be considered invalid.

The act of sending the Promo Code via SMS will be considered as the entry of the Participant in the Promo. Entries are deemed to be submitted at the time of receipt of acknowledgment of the Promo Code and not at the time of transmission by the Participants. Organizers do not guarantee submission of the Promo Code on SMS and are not responsible in case the Promo Code does not get submitted due to any reason, including network problem. The database of Promo Codes maintained by the Organizer shall be considered final and no correspondence in this regard shall be entertained.

It is clarified that in addition to these terms and conditions, the Participant shall at all times be bound by the terms and conditions as imposed by the owner of the Assured Prize on usage of its websites, microsites, applications, usage of vouchers etc.

Organizer shall not be responsible for failure of third party to provide the Assured Prize to the Participant(s) or any downtime on the services, caused due to technical or other factors attributable at the end of the third party that may occur for reasons including but not limited to failure of hardware equipment, configuration issue, decisions, change in marketing plans and / or changes in regulations that are carried out by any judicial or quasi-judicial or regulatory body. Participant agrees that participation in this Promo is at its sole risk. Organizer, and their respective affiliates, and their officers, directors, employees, and agents disclaim all warranties, express or implied, including without limitation any warranty of merchantability, availability, and fitness for a purpose or non-infringement.

The Assured Prize and the Mega Prize (“Prize/s”), are non-transferable, non-returnable, non- refundable and non-negotiable. No requests for transfer or assignment or redemption of the benefits shall be entertained.

The offers under this Promo cannot be clubbed with any other offer.

The decision of Organizers shall be final with respect to all matters relating to this Promo and the result of this Promo and shall not be subject to review or appeal by any customer or by any third party.

The authorized subscriber of the phone number used to enter the Promo at the actual time of entry will be deemed to be the Participant and must comply with these Terms and Conditions, in the event of a dispute as to entries submitted by multiple users having the same phone number. The authorized account holder is deemed to be the natural person who is assigned to a phone number by a telecommunication service provider. However, a person with multiple mobile numbers with adequate documentation shall be eligible to avail the Mega Prize.

Entry will be void if it is incomplete or if customer uses robotic, automatic, programmed or similar entry methods.

Organizers shall not be liable for:

any incorrect, incomplete or inaccurate information, whether caused by website users, or by any equipment or programming associated with or utilized in this Promo and assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with website;

any printing or typographical errors in any materials associated with the Promo, injury or damage to your or any other computer or mobile resulting from downloading any materials in connection with the Promo

any increase or decrease in the market value of the Assured Prize/Mega Prize.
